Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act of 1990 and its amendments prohibit discrimination against persons with a disability in any program receiving federal financial assistance. Section 504/ADA and its amendments define a person with a disability as anyone who: has a mental or physical impairment which substantially limits one or more of a person's major life activities; has a record of physical or mental impairment; or is regarded as having a physical or mental impairment.
Schools have responsibilities to provide accommodations, modifications and necessary services for eligible individuals with disabilities.
USD #264 acknowledges its responsibility under Section 504/ADA and its amendments to avoid discrimination in policies and practices regarding students, patrons, and personnel. No discrimination against any person with a disability shall knowingly be permitted in any program or practice within USD #264.
